In seriousness (though i admire your spirit) why tempt the bear ? The epic audience is not a big enough market and they also are used to searching out alternative compatible products (as there is now no alternative.) A 6mm bunker will be picked up by anyone who plays any 6mm game.

Secondly - I would love the otter forge back in production as i never got a chance at purchase, I think that's unlikely. As i understand it US law explicitly states change scale does not constitute a significant design change - UK law is even tighter. Other forum items which were stylistic "updates" to dated figures may imho constitute a significant reinterpretation... And hey nothing to loosing in trying.

More importantly, i believe this means DID and Onslaught should receive no legitimate legal bullying as they are unique interpretations of archetypal sci-fi concepts.

Finally - i am not a lawyer/solicitor. i am in the design industry and have to deal with the chance of having my ass sued regularly, so, though I agree in principal with most of the advice given here : don't act on anything without consulting a paid/insured legal professional kids ;)

Well the Otter guy is gone and the forge is shuttered for Techno-Heresy.

Totally unrelated, there's this really neat guy around named Todd. I like his stuff like that Ordinatus that I've been waiting to get my hands on for 6 months or so now. I'd like to buy stuff from him. What he's making is far more interesting that tired and busted designs from GW anyways...

I think its important that we take a small reality check here. This ruling doesnt automaticaly open the door for anyone to make 40K miniatures and sell them online. In fact, for Epic, it doesnt actually change a lot.

The concept of a (for example) 40K Eldar Wraithfighter remains GWs design. Even though it has never been produced at 6mm scale, and never will be most likely, it cant be copied or replicated. This has not changed.

There is still a niche for proxy miniatures, designs which are entirely new and which could potentially be used to represent the Wraithfighter in a 6mm game, but then this must be clearly specified as not being a GW Wraithfighter or an official product. This also has not changed.

Copyright protects broadly two things:
- the IP of design and original work
- the name of a company by not allowing confusion in the marketplace and the customer thinking that they are buying an official product when they are not

While I am pleased that the CHS judgement has resulted in a ruling that appears to put the C&D-friendly practices of GW appearing to claim legal rights over the most generic ideas that they do not own in a policy of 'might is right', it has not changed the position of miniature production and the legalities of it in a huge way.

The biggest effects that I can see are;
1. The production of GW compatible parts and miniatures are more open.
2. Other heavy handed tactics by GW legal are likely to be looked at twice on both sides.
