This assumes a lot, Corey. Sometimes you just get outplayed, sometimes things don't work out the way you want. Sometimes you -gasp- decide not to take the tomb complex. And you're missing the point; this is about what happens at a specific moment in a part of a game, not over the long term.

No, its a clarification to a rule just like Dave suggested above. And it has never been resolved as far as I know. This is just necessary to clarify more for the Necrons because of the nature of the army.

Or you could Marshal out of the portal and automatically pass your activation.
You are oversimplifying again and not taking into account that certain things can still go wrong. What if your formation off board has BMs and you try to retain with a marshall action. You don't automatically activate so you still fail.

Your concern is unwarranted. If you re-read Zombocom's and my posts, you can see we never played this way because it never came up before. But now that BMs are being retained on formations off board after rallying the situation is cropping up. The mechanics were never played incorrectly because the rules washed BMs away and made failing activations impossible.
Just realize this is not a exclusively Necron problem but it needs to be decided.
