Deamon summoning question

Played a game tonight and an interesting situation arose.

I had a garrisoned retinue on overwatch. As they were about to get shot by a decimator I decide to activate them and shoot.

The question is can I summon deamons at this point? We ruled that you could as you are activating the formation or should you test for summoning during deployment?

Thoughts?

I'd say no summoning.

You summon at the beginning of an action as part of the activation procedure.  Firing on OW doesn't follow that sequence, so I'd say no summoning.  Similarly, setting up on OW doesn't follow normal activation so no "pre-game" summoning.

Agreed, here's the rule in question.

At the start of that formation?s action, before the action test dice roll is made, the formation may summon daemonic units from the Daemon Pool.

You've already passed the action test dice roll if you're on overwatch. Equally, if you start on overwatch then you've not taken an action per se.
