I totally agree with you Black Legion. That's my point ! Fluff-wise it doesn't make sense.

Actually, the split was specifically to highlight Black Legion background.

Black Legion - Chaos undivided.  Abaddon ordered daemon engines to be constructed en masse and while they aren't described in detail the impression is that there were a lot of versions beyond the Defiler.  The Epic BL list was supposed to bring in new daemon engines - the Deathwheel and the Decimator - as new undivided daemon engines.  While the BL might make use of allied groups of various daemonic factions, the idea was to keep the daemon engines as "pure" undivided.

In fact, there weren't even supposed to be chaos titans in the list.  The undivided daemon engines were supposed to be the only war engines.  It was only after it became clear that there would be no new models that Jervis relented and allowed the titans to be added.

CSM cult legions would have their faction-specific engines.  The remaining non-aligned CSM legions would probably not rely on daemon engines as much as either BL or the cults.  Daemons are cannon fodder for the CSMs more than allies.

Kleomenes explained the more intense reliance on daemon engines in the cultist lists rather well - easier for them to build a housing and bind the daemons in secret than produce real military units.  They would have only low-level pilfered and traitored military gear and rely on the daemon engines for the heavy support.

I also like the distinction. You could probably make some kind of an argument for every unit in the combined forces being available to both types of army. I also think that the CSM are less likely to rely on Daemons. They dont need to power jump quite so bad, and are more aware of the sacrifices (in every sense!) that need to be made. I also think that following the background as set out in the 40K Codex books is not such a bad thing (as long as we dont over-rely on it).

Well as always DWWFY ! As I said, I base my CSM/Cultist TO&Es on SM1 and 2 ... I'm so Old School ! :D  I was just wondering based on my conversation with GreyWolf and SM1 experience. And both Neal and Kleos make good points. And I was unaware of the BL fluff ... I was relying on the past fluff !  Doh ! And Irondeath, you must not be aware of my stand on all Epic rules - Do What Works For You (DWWFY). I've said, that many times before ... again unless you are playing in Tournaments. And I never would, as we don't follow the Epic rules to the letter and never have. We have always felt the Epic rules fell short for us. Even though Epic:A was certainly the best of thelot, IMO.. So we modified things to suit us ... not Jervis & Andy, Pixilgeek, Neal, Irondeath, the =][=, Commissars,  3 Wise men from the East, Bigfoot, Nessie, Little Grays, UBL, Santa Claus, etc., etc. !    But back OT !! I was relying on my knowlegde of the old fluff ... But again both Neal & Kleo make sense too.  And behind it all ... since G/W stopped supporting Epic, the online "rule makers" had to adapt and overcome ... and did ! So again, bottomline to one & all - DWWFY ! :;):
