Agreed. The way that I understood it is that this could be theoretical or projected loss of profit. So, whether GW would lose money if they ever produce these in the future - even if they dont.

Of course, it's worth checking local laws - ex-GW sculptor Felix Panigua produces miniatures in his 'Avatars of War' range which are obviously GW IP style - paticularly the Orcs and Goblins. But he can't be stopped, because he moved to Spain to do it - and GW can't stop him thanks to Spanish law!

I know nothing of Spanish law myself, but have no reason to doubt Felix's word. So the answer is, let's all re-locate to Spain and take control of Epic!

Oh, and one more time: Rozmax, awesome sculpting! :;):

Both the UK and Spain share common IP and copyright laws via the European Community and if GW wanted to do something about him they would and could.

Felix isn't being sued because he is not using anything that GW has copyrights on and is producing generic fantasy figures for his own arena combat game.

There is a vast gulf of material that GW can't sue you for. Accept, it appears, dwarfs with mohawks. But that is another issue.

GW could attempt to sue him but what would be the point. And if they haven't sued Gamezone then Felix is so free and clear it isn't funny.

The issue here is dramatically different though as there is no question that these are based on GW IP.

These are so good I still think you've just painted 40K figures green and taken a slightly fuzzy picture of them  :vD   Amazingly good.

Great, great stuff!.

From an IP point of view this would be considered a derivative work and you'd get in legal doo-doo if you tried to mass produce and sell it.

Of course if you find your sculpts "burden" you in any way, drop 'ol primarch a line...

WOW!! These are among the best 6mm miniatures I've ever seen!

So, what happened - is he still making his army? Did he find a way to fast-duplicate the miniatures?

Did he stop the whole thing?

Anyone know anything?

Meaning "we would love doing them, but GW refuse to give us permission".
Might it be that GW think that Necrons only appear in small groups? So small they are not suited for epic scale conflict.
But that would mean they are not in Apocalypse neither. Are they?
