Legally speaking, GW presented CHS with such an aggressive law suit that CHS was given two choices:
1 - Immediately close down their entire business, and destroy all their moulds and master models, as demanded by GW.
2 - Fight GW's demands in a court case, and if they lose then do everything in #1 (But also, maybe win the case, or only lose on some counts).
CHS was given no incentive *not* to fight the case, because of the huge penalties GW was demanding they had nothing to lose by trying to find some representation (Which they found, in some of the best lawyers in the business, who're working for them for free, presumably because they think that the case is interesting
and that they can win on at least some counts... I don't believe you'd get
pro-bono representation from a US law firm of this calibre if they thought taking on the case would make them look bad!) and suddenly the tiny company GW thought would roll over and die without a fight was costing GW big bucks.
GW's now reached a position where they can't pull out of the case because that'd weaken their IP in showing they can't defend it, but also any judgement against GW in the case will also weaken their IP. It's lose-lose for GW at this point, unless they win on all counts, which is pretty unlikely.
