For the same reason as CHS has a good chance of winning parts of the case: A lot of that IP is actually pretty weak, and even minor differences are enough to make the new design unique enough to stand as its own IP.

Legally speaking, GW presented CHS with such an aggressive law suit that CHS was given two choices:

1 - Immediately close down their entire business, and destroy all their moulds and master models, as demanded by GW.

2 - Fight GW's demands in a court case, and if they lose then do everything in #1 (But also, maybe win the case, or only lose on some counts).

CHS was given no incentive *not* to fight the case, because of the huge penalties GW was demanding they had nothing to lose by trying to find some representation (Which they found, in some of the best lawyers in the business, who're working for them for free, presumably because they think that the case is interesting and that they can win on at least some counts... I don't believe you'd get pro-bono representation from a US law firm of this calibre if they thought taking on the case would make them look bad!) and suddenly the tiny company GW thought would roll over and die without a fight was costing GW big bucks.

GW's now reached a position where they can't pull out of the case because that'd weaken their IP in showing they can't defend it, but also any judgement against GW in the case will also weaken their IP. It's lose-lose for GW at this point, unless they win on all counts, which is pretty unlikely.

well to pull it back to the topic, If this is truly the case, I have just made my last GW purchases. I hope FW keeps their stuff up a few more months as I need more form their site than I can afford.

I just fixed that too, Now I am not beholden to the whims of GW or FW when it comes to epic.

Madmagician, I don't think it's that clear cut. I mean heck, they had a conversion kit that they actually called "Tervigon conversion kit." I think they went too far with their naming.

It's completely legal to use the name like that as a description, it's copying a design that's illegal.

If you assume the worst that at some point the entire epic range disappears from the GW store then epic is actually the best positioned to survive.
GW don't really have particularly unique IP anyway as it is generally based on common themes, that of common fantasy races in space (humans, elves, dwarfs, orcs. skeletons etc) and a wide range of vehicles are based on real tanks although there are exceptions of course . Then you throw in the size, 6mm infantry (at the very least) is quite generic as the detail that would distinguish a figure as a GW design isn't there. You would only really run into problems with certain races if you don't want quite different looking proxies (Eldar, particularly the Aspects would be tough to get a generic equivalent version of).

I think it will be pretty bad if Epic disappears from GW due to the resin switch over.
I've run into a couple of large ebay wins and have gotten most of my IG, tyranids, SM, and orks that way. But to my eye everything is pretty unique looking, except for Imperial Guard infantry.
Furthermore, Most of the proxy choices out there for armor look so generic and/or contrary to fluff you might as well just use modern 6mm army stuff. And no company just anyone can buy from makes anything like a: space marine, space ork, (or tyranid). I was just starting to collect Eldar and was looking at the Space Marine line, wanting the 'new' mk iv stuff, so I guess I better part with some cash quick, as the newer stuff is actually the rarer stuff on Ebay.
I was kinda hoping there was going to be more openess from GW towards Epic due to there recent mentions of Specialist Games on the website but this resin issue looks like it could put a real kink in that.
