I purchased a RPG accessory from ebay. In the listing it had the the cover pic of the item and the description had the item's name and condition.

When it arrived it was missing the map.

I contacted the seller three times before he answered, and he claimed to have answered the two previous messages blaming the spam filters of my server. However, the messages were sent via ebay messenger and, thus, go to the ebay inbox as well as to email.

Even though nothing in the description hinted at the item being incomplete the person was, IMO, rather aggressive and stated he only lists items as is (i.e. what they include) and buyers should ask him about the items before bidding. Please note that a complete accessory contains cardboard covers, two booklets and a map. He didn't list the contents present (two booklets and the covers). Nor was there a pic of the contents, just a pic of the cover. So IMO he did NOT list the item as is but implied the item was complete.

When I said that IMO it is his responsibility as the seller to state whether the items are complete or not he said he can't know what each and every item he has never seen should include. To that I replied that if he really does not know for sure he should at least put a line to the description stating he is not sure whether the item is complete like most other ebay sellers I have seen do.

I wanted a recompense for the missing part but he said he does not give partial refunds (as according to him is ebay policy) and if I didn't like the item I should send it back for a refund. Minus the postage, I'll just be getting the item price back. So I will be getting a refund but sending the item back will cost almost as much as the refund. I'll send it back anyway as this is now a matter of principle.

However, the question I'm asking is this: do you think it is the seller's responsibility to be as accurate as possible with the item listings? Or am I just being a stupid whiner who should have asked what the item included in the first place? Who in your opinion has the moral high ground in this case?

Yes, should say complete, incomplete or unknown. Anything else is obfuscation.

And get his receipt for his true postage, not the made up for ebay one (it should be the same as yours!).

I just learned a new word today :D

And get his receipt for his true postage, not the made up for ebay one (it should be the same as yours!).

A reciept would be nice. However I wouldn't expect the price to be the same for overseas shipment. I know the Danish postal service is hideously expensive compared to the British for example (recently we experienced a 30% price hike on all private mail!)

It is tricky though: I agree that it would be good service to at least state if they're not sure werther a set is complete or not. This way he did it maks it pretty much impossible to know werther he was acting out of good faith, was just being sloppy, or was actually trying to scam you.

He certainly should have made it clear he didn't know if the item was complete. While I understand the difficulty in ensuring something is complete, it's easy to put a line in saying so like most sellers of old games do. The fact that he neither showed the item nor indicated any uncertainty about its completeness is IMO most likely deliberate.

Whatever you do, leave feedback! I think a lot of crooked people on ebay are able to mantain their reputation because people are reluctant to do that.

I have had similar situations to this (but with Transformers... yay!). The item shows pictures but doesnt include a specific part, and the contents list doesnt include it either. When I dont get a response, I simply dont buy, and I believe that this is the 'letter of the law' by eBay - if you are not sure, dont bid.

However, I am sympathetic. When you see an item that you have been looking for, it is difficult not to click. And, when the seller doesnt get back it is a no-win situation.

I would say that the worst part of this is the sellers attitude. The same situation with a seller who was more approachable would have made it all a lot easier.
