Well ,didn't thi turm to S(you know the rest). A parent bought my army for his son, not having a shmick about gaming thought it was a 40K army and then has a go at me for trying to pull a dodgy. So my army will be returning the the Australis sector on the southern rim. Another bad ebay listing, I wonder if ebay will refund my payment? I will have to check. Cheers CAL  |

IMO, the winner is clearly at fault here. Nowhere did you say the auction is for 40k. I really don't see how he can blame you for trying to pull something shady.  |

He does have a legal right to be able to return the products however. I always make it triple-certain to point out any Epic auctions I put up, it's surprising how many people will bid without thinking when they think they've spotted an opertunity.  |

That depends on the jurisdiction. Very true, but CAL's in the UK(?) so the returns period applies. I wouldn't feel bad about anything and if eBay won't waive the fees in relisting it, I would withhold it from the refund if that's legal where you are. Legally speaking I'm not sure who pays for the returns postage either.  |

CAL's in Aus I think. I would suspect that the buyer would have to pay postage to return the item. Personally I would only refund the fee minus the listing cost and any other expenses that he's had to pay. ?As he's not UK based it's only through his own good will he is accepting the item back, I don't think legally the buyer is entitled to anything. ?I know UK based people buying from the US have major problems with this, not sure on Aus though. The buyer is clearly at fault here.  |

I am in Aus, I will refund his money in the interest of being an honourable bloke. The guy is a dick for sure, but he did make a mistake. I am not going to punnish the man for being an idiot and not knowing what he is buying. I gave him some advice on what to look for and that a 40K army that size would cost him a small fortune. I will relist the item once it has made it back and I know it is in good shape. As for ebay, no reply yet on whether or not I can relist without incuring more fees. I like honesty in people, and it really gives me the S(you know it), when someone is dishonest on ebay. Cheers CAL  |

Well, this has gone way past the joke as an ebay auction. I got my box back the other day after about two months, only to find that the buyer has kept all the vehicles. Yes you got it, an F ---ing theif on ebay. Mikemarthy is his username. Lucky for me I haven't refunded his money yet and will not be refunding a brass razoo. Cheers from the not to happy CAL  |
