Post subject:  Advice on guy not sending me back my minatures

Hi Guys,
Wanted to get some advice before things went nuclear.
I brought a large army of Skaven from this chap a while back. We then agreed that he would paint some other miniatures so I sent them on (I have a full email trail of events etc).
He has gone quiet within the last 3 months not answering my calls, texts or emails. I have therefore typed up a letter asking for them back, saying I will cover work done, miniatures brought by him and P&P. This letter is written in a friendly way i.e. hope everything is ok etc as I actually really like the guy. I have asked for my chaps back within two weeks. I will of course send the letter recordered.
If I don't get anything back then I plan to write saying that I have no other choice but to start legal proceedings if he doesn't send them back within a week.
I am a barrister so am quite confident about actually carrying out this threat and in getting a solicitor to draw up a letter. I am also sure of my legal position. I just wanted to get an idea if any of you had had a similar experience and what you did as I really don't want to go down the legal route.

Fortunately I haven't been in this situation (yet - touch wood!) Rob but it sounds like you have the situation covered! What you're suggesting doesn't sound unreasonable at all, you're being polite and curteous and giving the guy every opportunity to sort the situation, so if all else fails you know the law is on your side! Unless there is a very good reason that he can't phone or email you back (ie he's in hospital) then hell mend him.

Not sure about your specific country but a Letter Of Demand is what i would do.

Outlining the agreement, the current situation, the outcome you desire, the timeframe you expect this outcome to be adhered to and the action you will take if the outcome doesnt take place.
