Maybe not legal but once I buy something I will do any d.....d thing I want in my house. I would most likely do it as a conversion as I convert nearly everything in some manner.

Selling it is another matter. Don't bite the hand of your manufacturers. We need these guys for our hobby.

If it is OOP, it is fair game in my book. It is like picking something out of the trash. They abandoned it.

I am sure the legal eagles may disagree but, you know what? I don't care.

I don't like that they are selling someone else's recasting.  Don't get me wrong, GW irks me, sucks that you have to pay $100 for a miniature once it's OOP but I just can't see buying a recasting.

Recasting the stuff for your own personal use for bitz?  Maybe, recasting and selling for profit, no.

So what about cast of minis that do not exist?

I forget who... but someone has an awesome Necron army that they cast the Monoliths for...

Technically, this is not legal as the image of the Monolith itself is copyrighted.

Is it alright for him to sell the mini then?  Legally it is not... but are we as a community Lawful or Neutral?

GW can't sue you for casting non existent miniatures. They may yell at the name if you use one of their brand, or sue you if you try too much to replicate their distinctive features. ?:glare:

I've heard of a small company brought to court by GW because they were selling "alternate" Space Marines; they were different, but had very close features: helmets, shoulder pads, etc. The court had identified 14 differences, but they had been found guilty in the end. ?:(

However, I doubt anyone can claim an Epic scale miniature is in any way "challenging" a 28 mm one: one must be completely blind not to see the difference.

It means Dark Realm miniatures are perfectly legal, BTW. He could have even made them closer to actual miniatures.

I think GW can take issue with minis that infringe on intellectual property. Meaning, if someone were to create a 6mm version of a 40k mini, then GW can sue.

I would agree with DS- if GW can prove that the essence of a distictly GW design is being ripped off then I imagine they could sue.  Ironic given their track record *cough* Genestealers *cough*  :alien:
