Post subject:  GW forbids all Fanwork-Movies & Films

GW's nwe IP-Policiy forbids any kind of Fanwork Movies and Films.
It is ours now to show that we are not willing to let that happen to us.
Today it's the movies, tomorrow they may get the idea of forbidding any Fanwork stories and Fluffworks.
The whole community sat still far enough - now it is time to show them that we aren't the mindless consume-kiddies they like to think we are.

So spread this message to all forums you know and do your part.

This decision is outrageously stupid. I've seen many stupid decisions from GW, but this certainly is in my top 5. Personally I've been waiting for many years to see this movie and this is really disappointing.

If you feel the same about this, feel free to drop GW Legal a polite email at Legal@games-workshop.co.uk. I am certain this is not for legal reasons, there are too many precedences in other franchises.

I'm hardly an expert on continental v. US/English IP laws, but my understanding is that continental law states that creators have certain inalienable rights to their work.  Inalienable = cannot be transferred.  If GW allows the movie, the creators unavoidably gain certain rights over GW's IP and GW then cannot prevent others from doing likewise.  Basically, it breaks GW's IP.

I hate to be a stick-in-the-mud, especially when it comes to GW, but GW has every right to protect its IP. Nor do I believe the slippery slope argument that today it's movies, tomorrow it's something else GW will forbid.

GW does indeed have to protect its IP rights. And from the sound of it this has come about specifically because of differences in the copyright laws in Germany.

IP and copyright law are based on the idea that you only can claim them if you enforce/protect them. If you don't and can be proven not to then those copyrights are no longer valid.

The issue is more about the lack of distinction in copyright law between commercial and non-commercial use

But to take this example to heart, what does this mean for all the work we are doing/may do in the future with these supplements?  I wonder if there is a distinction if there is no profit revolving around the use of the IP. ???

GW seems to lurch around drunkenly with respect to its customers, no matter how long standing, well-intentioned, or not-for-profit.

That's probably a good guess. If anything, the free work being done for E:A will help GW sell more minis.

Wow, I just had a look at the IP rules at GW. They are already prohibiting quite a lot, have a look: http://uk.games-workshop.com/legal/cana ... /#cannotdo

They are just not (yet?) mad enough to assert these things in full. The rule about tattoos is great.

Not true for Germany at least. You can always claim your copyright if you can prove that it was your creation and it is regarded as a creation on its own by the judge.

GW wouldn't lose anything by simply letting the fans go ahead and release the movie. The key word is tolerance.

And I somehow doubt that there were any copyrights lost because of fan movies.

I've known about the tat ruling for quite a while now, GWs harsh/stingent miserly atitude is crap to be blount, lots of other even more successfull companies coexist with their fans efforts just fine. Lucas films and all the star wars shorts and parady movies come to mind, or for the Brits some of the fan produced Doctor Who stuff, or even the tons of Star Trek fan efforts out there, all exist perfectly fine alongside the companies that inspired them, then you have Games Workshop, who even had this movie featured in White Dwarf at one point pulling this crap. I really think GW just likes Bad PR to be honest.
