however even if it is all your own work and looks like the original then you would still be infringing copyright

also don't forget that a lot of GW icons and logos are in fact trademarks and are covered by trademark law which is something else to IP and copyright.

And in th USA, keep in mind Trademark laws are stronger, harsher on those who violate them, and do not expire, ever.

It is not hard, relativly speaking, to challange a copyright in court. The reason it does not happen more often is cost.

Trademarks on the other hand are much harder to crack.

But... but... I use their logos on my epic page... and used to have catalogue pics as well... :oo  

... they even put a link to my site on their Specialist games page, so I doubt they mind me using their logos toooo much!! Hey its free advertising.

True. One thing is definitely what they in principle has to do to everybody. However you simply had to move your site to a new server or URL and they'd have to start all over which just isn't practical. I suppose they do send a couple of mails out every now and then to people who are way out of line. Just to make an example and show that they are in fact enforcing their IP policy. But it is more or less impossible to police the entire net.

... oh, and you're absolutely right: many of the fan sites deliver more great original material and inspiration than GW has the manpower or resources to do. They are very well aware of the free advertizement these sites deliver.

is actually a sensible answer in many respects.

Remember a lot of what I am saying is either my interpretation of UK copyright law (and I do know a bit about US law as well).

On my own website I have some GW logos for different sections, ie Epic:A and Warmaster.

I do not use GW artwork or photographs on my website, I only use photographs I have taken or have been submitted to me.

The only exception is when reviewing particular items (these reviews usually happen on my blog) when I may use a GW image as part of that review.

One of the largest problems with conversations like this is there is the Truth and then there is reality. Jimbo is telling you the truth. Regardless of anidotal stories to the contrary, GW says no to just about everything.

Further they assign an agreement to the use of their web sites that is based on English law. Thus you are bound (yes you agreed when you went to their site) by those laws.

Just because someone has gotten away with copyright infringement and Trademark violations does not change the fact that they are wrong.

The reality is, GW will chase down those who effect them the most first. If dafrca has some photos of minis without the creadit as outlined on the GW site, the reality is he might get away with it for a long time. But if he has PDFs of their books for download, well then expect quicker action from GW.

Jimbo has given some good advice. Use caution with GW and their IP.

GW has written quite a complex and inclusive policy and it would be hard to build a site not in violation of it in some way or another.  :L

Added the first page of the Terrain section, updated the Speed Freeks page with FigghtaBommerz and Bommerz and did a few tweak other places. I've snapped pics of some Chaos stuff so hopefully I'll have some Khorne and Nurgle pages up in the Chaos secion very soon.
Also I've begun construction on the Feral Ork section but for obvious reasons that will not be up on the site for at least a couple of months.

you may think that, but I couldn't possibly comment...

actually a lot (well some) of what is on the GW page is in fact inaccurate and does not always need to be followed, just because GW says so...

For example

Photos of Painted Models

We encourage fellow hobbyists to show off their painting skills by taking photos of their miniatures and putting the on the site. Please remember to correctly credit the IP - "miniature ? Games Workshop Ltd 2003-2004. All rights reserved. Used without permission - model painted by xxxxxxx"


A photograph of a GW miniature does not infringe their IP.

A photograph of a GW publication does.

You could not confuse a photograph with a miniature, and you are not pretending that your photograph is a miniature.

You do not need to (as far as my knowledge of copyright law goes) credit the IP of the miniature on a photograph.
GW has written quite a complex and inclusive policy and it would be hard to build a site not in violation of it in some way or another.

if it was about anything other than GW I guess it might be okay...

Sure; no problem. If you'd prefer a pic where the model has been primed white I can put up one for you. It might be easier to spot detail that way.

Sorry about all the broken links. I suppose I should have more pages finished before I submit the links. :p
The next page will contain slightly more complicated stuff like Cityfight pieces, a ruined Tank Factory, a Basilica and Ork Strongholds. In time I'll keep adding to this "Advanced" section. but I thought I'd do a page with some of the basics first. :)
