if i have a unit in the woods firing through 9cm of woods to a unit in the open, would that unit get a to hit modifier (cover save)?

"1.8.2 Cover To Hit Modifiers
Units that are in terrain that is tall enough to at least
partially obscure them from an attacker’s view receive a
-1 to hit modifier when being shot at (see 1.9.5). The to
hit modifier also applies if intervening terrain obscures
the target partially from view."

If your units are IN the woods, the terrain is not intervening, so no.

If your units are on the other side of the woods, it is, so yes.

Keep in mind that there is a difference between a to hit modifier and a cover save.

There was a difference of opinion last night on applying the cover modifier.

MNB suggested that if formation X was 9cm into the woods and firing at formation Y in the open that was (let's say) 10cm out of the woods, the shots coming from X would suffer a -1 penalty.  I.e. their LOS would be partially obscured and therefore you would apply the modifier "generously" as EA describes.

Ronsandt and I argued that formation X in the woods would be set up to fire out of the woods and that it seemed not in the spirit of troops in cover to be penalized on their firing.  I.e. if both X and Y receive a -1 to their hits, there would be no difference in being in cover or out of cover (other than the cover save, of course).  

However the 'apply generously' rule seems to fit here.  I suggested dropping the situation here for discussion.

Firing out of cover doesn't give the -1 modifier. If it did cover would be much less useful.

The "partially obscures" for intervening terrain is for things like hull down positions or a titan that is half-way behind a stand of trees and such things.  It is not supposed to apply to terrain you're firing out of.

If it were supposed to apply, then how do you apply it?  How far is enough terrain to count - 1 cm, 5cm,  any at all?

It would also greatly complicate the issue with respect to choosing in/out of cover targets as any formation with some units behind the "partially obscured" dividing line would have some units with cover mods and some without.
