A an important piece of the puzzle - the paintjob.

As I undarstand it (disclaimer: I'm not a lawyer), there are three copyrights at stake in a picture of a painted model: the model itself, the paintjob, and the photograph.

Yep if the paint job counts as a significant enough original piece then it is all fine. I just dunno if it does or not?

I suspect the answer would be strongly related to the amount of money you have.

Sure, and there would be a lot of grey area as well i think, consider this:

LOTR films exist, using IP licensed from the tolkien estate (i assume?).
GW make minis form these films, to do this they need permission from the first two guys, making a sculpt from a film would be infringement, the change of medium, mode and dimension is not enough for it to be different enough – if GW handt got a license then then film people/estate could claim it as a derivative work they owned + claim money made from it.
If i then paint that figure to match the film, presumably I cannot claim that paint job as my own, it would be a derivative work of new line cinema's licensed interpretation of tolkien's work.
So i'm not sure where the line on a paint job being significant enough would be drawn. If i paint Aragorn lime green that is a lot different, but there would be a lot of stuff in between.

None of you lot are lawyers; spending the last few pages pretending you are is entirely pointless.

Remainds me of Speedball on the Aimga (except for the orcs). Ah, fond memories of the early nineties...

Believe it or not i managed to miss this thread until yesterday. Having read through this subject i find myself deeply saddened over such events.

It was indeed forumware that got me back into epic after a long spell doing historical micro armour collecting. For me personally collecting the model armies is my thing, with gaming being secondary, so as you can imagine i am feeling rather sad :(

I have always collected the imperial armour books from FW and follow several BL series novels too, and probably still will but without new models based on FW designs being made how will i maintain my interest. Proxy model are fine but i like the real thing after all a landraider is a landraider nothing else will do, i don't like being forced to go with counts as models.

The 40K universe is where i want to play i love the dark gothic background and refuse to allow GW to sour my interest.

I understand that the TC forum must do what it must do to protect itself, and i thank CS for telling us the reasons that this has happened.

It just seems to me that this is the final nail in the epic coffin and that the box is now going in the ground.
Hope i am wrong, and i will still try to update my thread regularly but many of my future painting project contain models that i can no longer show so we will see.

Regards

At this point, and I want to be clear about this, policy on pictures in blogs, battle reports, suppliment work, army group shots, etc is entirely unchanged. No pictures have been taken down of these, and I don't intend to take any pictures down of these. I can only treat these on a case by case basis and so please continue to act as you have done in the past. I dont want to censor pictures or exclude any. I only ask that people are aware of the situation and the context and I reserve the right to remove anything I feel is an issue or contact the poster to ask it to be removed/replaced. At this point, it is only the sale and distribution that I am looking at.

So just keep on keepin' on.

The fact that AFAIK there has been only one person targetted points to me that TC isn't involved.

As much as GWs behaviour is annoying IMO moreso is the people who have posted threads on other forums organising joint orders and even putting PDFs online. They might as well have emailed lenton themselves

first rule of Fight Club...you don't talk about Fight Club....
Or in this case, the First rule should have been, you don't talk about Forumware.
